Copyright protection subsists in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device (1) to reproduce the copyrighted work in copies or phonorecords; (2) to distribute copies or phonorecords of the copyrighted work to the public by sale or other transfer of ownership, or by rental, lease, or lending; Hak cipta adalah hak eksklusif bagi pencipta atau penerima hak untuk mengumumkan atau memperbanyak ciptaannya atau memberi izin untuk itu. Pengumuman = pembacaan, penyiaran, pameran, penjualan, pengedaran, atau penyebaran Media = apapun sejauh bisa dibaca, didengar, atau dilihat orang lain Perbanyakan = penambahan jumlah keseluruhan / bagian yang sangat substansial dengan menggunakan bahan apa pun Pencipta = seorang/beberapa yang melahirkan suatu ciptaan berdasarkan kemampuan pikiran, imajinasi, kecekatan, keterampilan, atau keahlian.

4 Intellectual Property Management (WK-1)Page 4 Teddy Sjafrizal @2015 DEFINITION Copyright law is designed to prevent the public from copying the author ’ s expression, while anyone is free to evolve their own expression of the same concepts, or to use the expressions of the author, so long as there are no copies made. Copyright law provides authors with a vehicle for securing the economic reward afforded by the marketplace, stimulates the creation and dissemination of intellectual works, allows publishers and other distributors to invest their resources in making the works of the creators available to the public Questions : 1. When does fixing an electronic program on a CD, disk or hard drive become protected by copyright law ? 2. A copyrighted novel or software is sold to a buyer, the buyer can use the work by reading it as many times as he or she wishes, or the buyer can sell, lease or rent that copy of the work to another, or the owner may even mutilate and destroy the work.

Ciptaan = hasil karya pencipta yang menunjukkan keasliannya dalam lapangan ilmu pengetahuan, seni, atau sastra. (3) in the case of literary, musical, dramatic, and choreographic works, pantomimes, and motion pictures and other audiovisual works, to perform the copyrighted work publicly; (4) in the case of literary, musical, dramatic, and choreographic works, pantomimes, and pictorial, graphic, or sculptural works, including the individual images of a motion picture or other audiovisual work, to display the copyrighted work publicly; and (5) in the case of sound recordings, to perform the copyrighted work publicly by means of a digital audio transmission.

Consideration for Fair Use Doctrine : 1. Consideration of the purpose and character of the use, such as whether the use is commercial, or is it for a non-profit educational purpose; 2. The nature of the copyrighted work; 3. The amount and substantially of the portion used in relation to the copyrighted work as a whole; and 4. The effect of the use upon the potential market for, or value of, the copyrighted work.

7 Intellectual Property Management (WK-1)Page 7 Teddy Sjafrizal @2015 SUBJECT MATTERS Works of authorship include the following categories: (1) literary works; (2) musical works, including any accompanying words; (3) dramatic works, including any accompanying music; (4) pantomimes and choreographic works; (5) pictorial, graphic, and sculptural works; (6) motion pictures and other audiovisual works; (7) sound recordings; and (8) architectural works. 8 Intellectual Property Management (WK-1)Page 8 Teddy Sjafrizal @2015 SUBJECT MATTERS Copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied in such work Requirements for a work to be protected : - Originality The requirement of “ originality ” is met by most works, so long as they embody some creative effort, and are not merely copies or plagiarism. - It be fixed in a tangible medium of expression Ciptaan yang tidak dilindungi ialah : Pengumuman dan/atau Perbanyakan lambang Negara dan lagu kebangsaan. pertunjukan atau pementasan yang tidak dipungut bayaran jika tidak merugikan kepentinganyang wajar dari Pencipta Dengan syarat penyebutan sumber, pengumuman berikut tidak termasuk pelanggaran jika:  untuk kepentingan pendidikan,  penelitian, penulisan karya ilmiah.  penyusunan laporan. Perlindungan terhadap suatu ciptaan timbul secara otomatis sejak ciptaan itu diwujudkan dalam bentuk nyata. Damages (1) the copyright owner’s actual damages and any additional profits of the Infringer. (2) Statutory damages Infringement was committed willfully, the court in its discretion may increase the award of statutory damages to a sum of not more than $100,000 for each infringing work. The evidence required to support a finding of infringement is: a) that the alleged infringer had access to the copyrighted work, and b) the infringing work is substantially similar to the copyrighted work Pemegang Hak Cipta berhak mengajukan gugatan ganti rugi kepada Pengadilan Niaga (1) meminta penyitaan terhadap benda yang diumumkan atau hasil Perbanyakan Ciptaan itu. (2) penyerahan seluruh atau sebagian penghasilan yang diperoleh, yang merupakan hasil pelanggaran Hak Cipta. (3) menghentikan kegiatan Pengumuman dan/atau Perbanyakan Ciptaan atau barang yang merupakan hasil pelanggaran Hak Cipta. Penjara dan denda maksimal 5 milyar rupiah

Napster, Inc (2001) Napster provided a platform for users to access and download compressed digital music files, specifically MP3s, from other users' machines. Napster included a central server that indexed connected users and files available on their machines, creating a searchable list of music available across Napster's network. The district court preliminarily enjoined Napster "from engaging in, or facilitating others in copying, downloading, uploading, transmitting, or distributing plaintiffs' copyrighted musical compositions and sound recordings, protected by either federal or state law, without express permission of the rights own. Sept-2001, Napster settled with songwriters and music publishers, agreeing to pay $26 million. May-2002. Napster files for bankruptcy
