2 HUKUM DEN HAAG Terdiri atas konvensi tahun 1899
dan konvensi tahun 1907 Terutama mengatur : “means and method of warfare” (mengatur alat dan cara dalam berperang)

3 PRINSIP-PRINSIP HUKUM DEN HAAG
Prinsip utama :”the rights of belligerents to adopt means of injuring the enemy is not unlimited Prinsip Martens Clause yang terdapat dalam Preamble Konvensi Den Haag

4 MARTENS CLAUSE “until a more complete code of the laws of war has been issued, the high contracting parties deem it expedient to declare that, in cases not included in the regulations adopted by them, the inhabitants and the belligerents remain under the protection and the rule of the principles of the law of nations, as they result from the usages established among civilized peoples, from the laws of humanity, and the dictates of the public conscience.”

5 KONVENSI DEN HAAG Konvensi Den Haag tahun 1907 menghasilkan 13 konvensi dan 1 deklarasi : Convention I for the Pacific Settlement of Disputes Convention II respecting the limitation of the employment of force for the recovery of Contract Debts; Convention III relative to the opening of hostilities. Convention IV respecting the law and customs of War and Land. Convention V respecting the rights and duties of neutral powers and persons in case of war on land.

6 Convention VI relating to the status of enemy merchant ships at the outbreak of hostilities.
Convention VII relating to the convention of Merchants Ships into War Ships. Convention VIII relating to the lying of the automatic submarine contact mines. Convention IX concerning bombardment by naval forces in time of war.

7 10. Convention X for the adoption to maritime warfare of the principles of the geneva convention.
Convention XI relative to certain restrictions with regard to the exercise of the right of capture in naval war. Convention XII relative to the creation of an international prize court. Convention XIII concerning the rights and duties of neutral powers in naval war.

9 Dapat dilihat bahwa sebagian besar dari konvensi tersebut mengatur perang di laut. Hanya ada satu konvensi yang mengatur perang di darat; yaitu konvensi 4. Konvensi 4 mempunyai suatu ‘annex’ yaitu yang lazim disebut Hague Regulations Ketentuan2 yg terdapat dlm Hague Regulations inilah yg sampai skrg mjd pegangan bagi para belligerents.

10 HUKUM GENEVA 1949 Konvensi-konvensi Geneva tahun 1949 terdiri dari empat buku : Konvensi Jenewa tahun 1949 mengenai perbaikan keadaan anggota angkatan perang yang luka dan sakit di medan pertempuran darat. Konvensi Jenewa tahun 1949 mengenai perbaikan keadaan anggota angkatan perang di laut yang luka, sakit, dan korban karam.

11 Konvensi Jenewa tahun 1949 mengenai perlakuan tawanan perang;
Konvensi Jenewa tahun 1949 mengenai perlindungan orang-orang sipil di waktu perang.

12 Apabila hukum Den Haag mengatur alat dan cara berperang (means and method of war);
hukum Jenewa mengatur perlindungan terhadap mereka yang menjadi korban perang

13 Beberapa Hal Penting Konvensi Jenewa (1)
Konvensi Jenewa 1949 selain mengatur perang yang bersifat internasional (perang/ konflik bersenjata antar negara), juga mengatur perang/ konflik bersenjata yang bersifat non internasional, yaitu perang/ konflik yang bersenjata yang terjadi di wilayah salah satu pihak peserta agung, antara pasukannya dengan pasukan bersenjata pembangkang/ pemberontak.

14 Beberapa Hal Penting Konvensi Jenewa (2)
Di dalam Konvensi tersebut terdapat apa yang disebut Ketentuan2 yang berlaku bersamaan (common articles), yaitu ketentuan2 yang dianggap sangat penting sehingga dicantumkan dalam keempat buku dengan perumusan yang sama.

15 PROTOKOL TAMBAHAN 1977 Protokol tambahan 1977 terdiri dari dua buku :
Protokol I, yang mengatur perang/ konflik bersenjata yg bersifat internasional, yaitu perang/ konflik bersenjata antar negara. Protokol II, yg mengatur perang/ konflik bersenjata yg bersifat non internasional, yaitu perang/ konflik yang terjadi di wilayah salah satu pihak peserta agung antara pasukannya dengan pasukan pemberontak.

16 Protokol Tambahan 1977 Memuat definisi yang belum terdapat dalam peraturan sebelumnya : Combat Penduduk sipil Sasaran militer Sasaran sipil

17 Memuat hal-hal baru, seperti :
Civil defence Mercenaries War of national liberation Tugas komandan Terbentuknya international fact finding.

18 SUMBER-SUMBER HUKUM HUMANITER YANG LAIN
Geneva Protocol 1925 for the prohibition of the use in war of asphyxiating, poisonous of the gases, and a bacteriological methods or warfare 1954 1st Hague Protocol for the protection of cultural property in the events of armed conflict. Convention on the prohibition of military or other hostile use of environmental modification technicques (Emmod Convention 1976).

19 Convention on the prohibition or restriction on the use of certain conventional weapons which may be deemed do be excessively injurious or to have indiscriminate effect (1980). Convention on the prohibition of the development, production, stockpiling and use of chemical weapons and on their of destruction.

20 6. 1995 protocol on blinding laser weapons;
Ottawa convention on the prohibitions of the Use, Stockpiling, Production, and Transfer of Antipersonel Mines and on their Destruction Second Hague Protocol for the Protection of Cultural Property in the event of armed conflict.
