April 24 Acceptance of Contract Award by BGP May 13 Pertamina approve the 2D Seismic Program May 21 Send Invitation letter to BGP for negotiation of work plan & Scope of work Clarification, on June 08, 2008 June 04 The Atlantic vessel refuse of acquisition jobs, due to security issue in Sudan. BGP management decided to bring the BGP Atlas (vessel replacement). The Atlas Vessel will be available in Mid August, after finished survey in South China Sea (attached detail schedule). June 09 Contract Negotiation with BGP (stand by condition, Vessel Equipments etc) June 15 CPOC accepted the technical proposal & mobilization delay (> 1 month) of the Atlas vessel. CPOC invite BGP to sign the contract on June 22, 2008. June 17 BGP proposed to vessel replacement (Atlas to MV Zephyr-1). Mobilization from Singapore on Mid July, 2008. Due to Atlas vessel reparation in Sunya-China. Propose the additional fee for mobilization & demobilization June 19 BGP has clarified the technical requirement of Zephyr-1 June 23 CPOC evaluate for technical specification of Zephyr-1 vessel, not reach CPOC requirement. CPOC need to inspect the vessel in Singapore as early June July 03-04 CPOC delegates visit Singapore to inspect Zephyr-1 and technical discussion

Chronology Chart Summary July 04 CPOC delegation has signed MOU with BGP team, CPOC & BGP agree as follows: CPOC accept & agrees to use this vessel for carrying out the 2D Seismic Survey BGP should be provide the charter agreement (BGP & DMNG) for using the Zephyr-1 CPOC & BGP commit to sign the contract, not later than July 15th, 2008 CPOC & BGP agree that the boat will start mobilization from Singapore on July 8th, 2008 & prepare to start the 2D seismic survey not later than July 31, 2008. CPOC will prepare all permits, customs & security clearance for the Zephyr-1 and chase vessel to enter into the working area in Sudan waters before 25th July. BPC should be provided all the supporting document before July 25th, 2008. July 08 BGP has informed the signing of chartered vessel agreement, Vessel will be departed from Singapore as July 09 and will arrived in Port Sudan about 17 days. BGP can’t send professional persons to attend the final negotiation, ask CPOC to send draft of final contract and will be responded as soon as possible. July 09 CPOC send revised seismic program to OEPA and partners for approval. consist: 28 regional lines (10x12 km) 2693 km & 62 infill line (3x3 km in the northern, 5x5 km in the southern) 3080 km. Totally 90 lines length 5773 km. July 13 CPOC send letter to BGP: inform Mr.Ibrahim as the Coordinator Project; the Official letter sent by fax, required the BGP Representative in Khartoum; Update Operation Schedule for support of Custom Clearance & work permits, Daily Log of Mobilization; completely of the chase vessel Document July 14 CPOC will prepare the all the permits, custom & security clearance for Seismic & Chase Vessels

CATATAN

Hasil pekerjaan: Waktu pelaksanaan & pekerjaan tidak sesuai dengan waktu yang direncanakan, sehingga hasilnya tidak optimal digunakan sebagai dasar pekerjaan selanjutnya (akuisisi seismik). Hal tersebut dikarenakan: Rusaknya alat gravity dan tidak ada cadangan alat sehingga ada masa berhenti pada saat pengambilan data pekerjaan banyak terhambat oleh kondisi alam dan politik dari Red Sea Sudan (gelombang dan masalah perbatasan) hal ini dikarenakan perencanaan waktu yang kurang baik Pekerjaan Interpretasi yang dilakukan oleh Consultant (dari CNPC) tidak begitu menguasai sehingga hasilnya tidak maksimal dan lama Pekerjaan tidak tercapai sesuai program 5919 KM, untuk Marine Gravity terealisasi 5462,5 km, dikarenakan tidak bisa dilakukan survey daerahberbatasan dengan Egypt dan Pulau Karang, untuk Marine survey Gravity darat 230 km terealisasi 239,3 km

Prosedur : Pekerjaan ini dilakukan dengan cara tunjuk langsung dimana tidak dilakukan proses tender. Dan mengakibatkan: Tidak adanya kontrol harga dan kualitas dari vendor lain, dimana harga akhir yang digunakan mengacu pada harga di block-15 (RSPOC) Penandatanganan kontrak dilakukan setelah pekerjaan sudah berlangsung (back date). Akibatnya: Adanya perjanjian pekerjaan yang tidak detail sehingga waktu pekerjaan konsultan tidak dibatasi dan berlangsung lebih dari 6 bulan; dimana biaya melebihi budget yang sudah ditentukan Perjanjian akomodasi tidak jelas sehingga banyak biaya yang dibayarkan oleh CPOC untuk kebutuhan consultant (ticket, akomodasi di sudan, dll) Tidak adanya Performance bond sehingga tidak ada control dari CPOC terhadap kontraktor

Biaya : Terjadinya pembengkakan biaya pelaksanaan pekerjaan tenaga konsultant dengan rincianrincian: WP&B 2007 AFE INVOICE Untuk pembayaran tenaga konsultant sebesar USD 115,200.00 Total biaya Marine Gravity USD 989,204.00

Lain-lain: Kesalahan yang terjadi pada pekerjaan Gravity diakibatkan kurangnya kontrol dari pihak Pertamina yang di CPOC, karena Kurangnya pengalaman dan persiapan dalam menangani pekerjaan di luar negeri. Kurangnya dukungan dari perwakilan SUDAPET (non paying partner) sehingga tidak ikut mengontrol pelaksanaan tender, perjanjian kerja, pekerjaan dan hasil pekerjaan. Untuk pekerjaan Gravity, Presiden CPOC hanya menyatakan Nilai kontrak /km, term dan condition sama dengan block-15 RSPOC, tetapi salinan kontrak tidak diberikan dan dibiarkan tenaga Pertamina bekerja dalam waktu singkat, padahal Cina mempunyai salinan kontraknya, hal ini membuat saudara Aref (CPL MGR) pada waktu itu mengundurkan diri, hal ini menunjukkan CNPC mempunyai rencana untuk tidak bekerjasama dengan baik.
